Amy Thomasson Terms & Conditions

These Terms & Conditions are between Amy Plans Your Magic, LLC d/b/a Travel Agent Amy (“Amy Thomasson” and/or “I/we/us/our”) and you, the purchaser of travel-related services. By booking, you agree to the terms and conditions as outlined below.

Acceptance of Terms Through Use of Services Engaging Amy Plans Your Magic, LLC d/b/a Travel Agent Amy (“Amy Thomasson,” “I/we/us/our”) for travel planning services, including consultation, quoting, itinerary development, booking assistance, or other travel-related services, and/or submitting payment for Agent Service Fees to Travelmation, LLC, constitutes your knowing and voluntary acceptance of these Terms & Conditions, the Travelmation Terms & Conditions, and all applicable supplier terms.

Proceeding with planning, approving itineraries, providing instructions to book, or authorizing payment confirms your agreement to be bound by these Terms & Conditions in full.

All policies, procedures, and terms are subject to change without notice.

Transportation Security Administration (TSA) regulations require you to provide your full name as it appears on your travel documents, date of birth, and gender at the time of booking for the purpose of watch-list screening. Failure to provide this information will result in you not being allowed to travel. For details, visit tsa.gov.

You agree to indemnify, defend, and hold harmless Amy Thomasson, Travelmation, and their officers, directors, employees, agents, and affiliates from and against any claims, demands, causes of action, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to your acts, omissions, breach of these Terms, or violation of the rights of any third party.

Nonrefundable Agent Service Fee The Travel Planning Fee/Agent Service Fee is a non-refundable professional service fee charged solely to include consultation, research, itinerary design, supplier sourcing, pricing analysis, and/or travel strategy development. This fee compensates Amy Thomasson for professional time, expertise, and intellectual property created during the planning process. Planning services commence upon client onboarding and placement into the active planning queue, which occurs upon receipt of the Travel Planning Fee. This fee does not include booking, is not a deposit, and is not applied toward travel costs. Booking travel occurs only if the client elects to proceed after reviewing planning recommendations. For purposes of service delivery and dispute resolution, the Travel Planning Fee is fully earned and planning services are deemed rendered and complete upon electronic delivery of travel quote or itinerary options to the client. Delivery of quotes constitutes fulfillment of the planning service, regardless of whether the client chooses to proceed with booking, delays decision-making, or decides not to travel. No finalized booking is required for planning services to be considered rendered. The Travel Planning Fee compensates for professional planning services only and does not include the booking or ticketing of travel. The Travel Planning Fee includes up to two quote or itinerary options based on professional assessment of the client’s stated needs. If a booking deposit is not placed within 90 days of quote delivery, planning services are considered concluded. Any future planning will require a new planning fee. The Client acknowledges that delays in decision-making, approvals, responses, or payments may result in changes to pricing, availability, or feasibility of recommended arrangements, and such changes do not constitute a failure to perform services. One revision after booking related to dates, accommodations, or airfare is included. Additional revisions or extended research may require an additional fee. If a client elects to cancel a trip after booking has been completed, Amy Thomasson may assess a post-booking cancellation and administrative service fee to compensate for professional time and services performed. These services may include, but are not limited to, supplier communications, cancellation processing, documentation, itinerary updates, advisory services, and administrative coordination required to unwind confirmed travel arrangements. The amount of this fee will vary based on the complexity of the booking and the scope of work required to process the cancellation and will range from $100 up to the total professional service value associated with the booking, not to exceed the compensation otherwise earned for services rendered. This fee is separate from and in addition to any supplier-imposed cancellation penalties or forfeited payments. In situations where no separate planning or agent service fee was charged due to anticipated compensation through booking, a post-booking cancellation fee may be applied to account for professional services already performed. Services outside the originally agreed scope, including but not limited to additional research, alternative itineraries, re-quoting, or extended advisory support, are provided at Amy Thomasson’s discretion and may require additional fees. Client dissatisfaction, preference changes, or decisions not to proceed with booking do not constitute non-delivery or defect of planning services. All Travel Planning Fees/Agent Service Fees are non-refundable once planning services have been completed through quote delivery. No refunds will be issued under any circumstances after planning recommendations have been delivered. If an Agent Service Fee is charged for services other than trip planning, the fee is deemed fully earned upon completion of the specific service requested. By submitting payment, the client acknowledges that the Travel Planning Fee is a professional service fee for planning and research services, not a charge for booked travel. The client further acknowledges that planning services are fulfilled upon delivery of travel quote options as described above. The Client agrees to make a good-faith effort to resolve any concerns directly with Amy Thomasson prior to initiating any dispute, chargeback, or third-party complaint. Amy Thomasson provides professional planning, advisory, and coordination services on a best-efforts basis. No outcome, pricing, availability, supplier decision, upgrade, or experience is guaranteed unless expressly confirmed in writing by the applicable supplier.

Credit Card Transactions & Chargebacks If for any reason, any travel service provider is unable to provide the services for which you have contracted, your remedy lies against the provider, and not against Travelmation, Amy Thomasson, or their suppliers. The client agrees to make a good-faith effort to resolve any billing concerns directly with Amy Thomasson prior to initiating a chargeback or payment dispute. If Travelmation, Amy Thomasson, or their suppliers incur any costs, including but not limited to attorneys’ fees, to recover any payments charged back by your credit card company, you agree that you will be liable for these costs. If the credit card is declined, you guarantee that you will settle any amounts owed immediately. Merchant processing fees and any chargeback fees are the responsibility of the cardholder.

Vendor Chargebacks & Agency/Agent Reimbursement In the event that you initiate a chargeback, dispute, reversal, or recollection of funds with a travel supplier, airline, hotel, cruise line, tour operator, or other vendor, and such action results in funds being withdrawn from, charged back to, or otherwise recovered from Travelmation or Amy Thomasson / Amy Plans Your Magic, LLC, you agree to reimburse Amy Thomasson / Amy Plans Your Magic, LLC for the full amount of any resulting loss, including the charged-back amount, forfeited commissions, administrative fees, penalties, and any costs incurred as a result of such chargeback or dispute.

This obligation applies regardless of whether the chargeback is successful and regardless of whether the chargeback is initiated directly with the supplier.

Required Entry/ Re-entry Documentation Proper documentation is YOUR responsibility. The following information is based on current requirements for U.S. citizens at time of publication. This information may change. Passengers returning to the U.S. by air from any international destination must have a valid passport and may be denied boarding by the airline if the passport is damaged, mutilated, or has excessive wear. A “Passport Card” is not acceptable. If your name on your passport (or for non-U.S. citizens, “valid travel documents”) does not match your name on your travel documentation, you will not be allowed to travel. A passport valid for up to 6 months past the date of completed travel is required when traveling to some international destinations. Married or divorced women traveling under names other than what is printed on their travel documents must supply a marriage license and/or divorce decree. If you are not a U.S. citizen, contact your destination’s consulate or embassy to determine required entry documents.

Passports are NOT required for travel within the continental U.S., Hawaii, Puerto Rico, and the U.S. Virgin Islands. However, travel to these U.S. destinations/ U.S. territories requires a valid state/government-issued picture I.D. or valid state-issued driver’s license. Beginning May 7, 2025, your valid state/government-issued picture I.D. or valid state-issued driver’s license must be compliant with the Real ID ACT in order to board domestic flights and access certain federal facilities. Visit dhs.gov/real-id for more information. If it is not compliant, visit tsa.gov/travel/security-screening/identification for alternate forms of acceptable ID. Any passenger who is denied boarding due to lack of proper documentation will have their vacation cancelled. Failure to comply with the above requirements will result in you not being allowed to travel and no refund will be given.

Denial of Entry Certain countries may deny entry to travelers with even a minor criminal record, and if not a U.S. citizen, entry back into the U.S. Check with the U.S. Embassy and the embassy or consulate of the country being visited to ensure you can travel as planned. Travelmation, Amy Thomasson, and their suppliers do not accept responsibility if you are denied entry and cancellation penalties apply.

Events Beyond Control I understand that Amy Thomasson and Travelmation are not liable for any losses, costs, injuries, or expenses resulting from circumstances beyond their reasonable control, including but not limited to natural disasters, weather events, acts of God, epidemics, labor disputes, civil unrest, terrorism, or government actions.

Force Majeure This Force Majeure provision is intended to supplement and reinforce the Events Beyond Control clause above. Amy Thomasson and Travelmation shall not be liable or responsible for any failure or delay in performance arising out of or caused by acts of God, natural disasters, weather events, epidemics, pandemics, acts of terrorism, civil disturbances, labor strikes, government actions, or any other circumstances beyond their reasonable control.

Collaboration & Communication Travel planning is a collaborative professional service that requires respectful communication, timely responses, trust in professional guidance, and adherence to established planning processes and boundaries. Amy Thomasson reserves the right to terminate services if, in her professional judgment, the client’s conduct, communication style, expectations, or actions materially interfere with the ability to provide services. This includes, but is not limited to, behavior that is abusive, harassing, threatening, or disrespectful toward Amy Thomasson or any member of her team.

Upon termination of services, all planning, advisory, booking, and support services will cease immediately. All planning fees, agent service fees, and administrative service fees paid shall be deemed fully earned and non-refundable. Any supplier bookings, cancellations, penalties, or refunds will remain subject to applicable supplier terms and conditions. Termination of services does not relieve the client of responsibility for any fees already incurred, supplier-imposed penalties, or obligations arising from services already performed.

Flights & Airport Check-in Your flight information will appear on the booking confirmation issued when you make your deposit, and on your electronic travel documents issued upon full payment. All flight times are subject to change without notice. We strongly suggest that you reconfirm exact flight times 24 hours prior to departure and again before departing for the airport. For international flights, we recommend arriving at the airport at least three hours prior to your scheduled departure time to allow time to check in and get through Security. For domestic flights, we recommend that you arrive two hours prior to travel but absolutely no later than one hour prior to travel. If you do not have pre-assigned seats and have seat preferences, we recommend that you arrive early as seats will be assigned upon check in based on availability.

If you do not check in at the airport or gate at the required time, or do not possess proper documentation, you will be denied boarding and may not be eligible for a refund. If you fail to check in for your flight without prior cancellation, you are considered a no-show and will not be eligible for a refund. Travel Protection may not cover the instances noted above.

If an infant reaches the age of two at any time during the vacation, federal law requires the purchase of a separate seat for any remaining portions of the flight. Some countries charge infant departure taxes.

Client Conduct; Denial of Boarding; Removal; Detention You agree to conduct yourself in a lawful, respectful, and appropriate manner at all times while traveling, including compliance with airline Conditions of Carriage, crew instructions, supplier rules, and local laws.

If you or any member of your traveling party engages in disruptive, abusive, intoxicated, aggressive, unsafe, or otherwise inappropriate behavior that results in denial of boarding, removal from an aircraft, removal from a hotel or tour, detention, arrest, fines, or any law enforcement or governmental action, all resulting costs, penalties, losses, missed services, rebooking fees, cancellations, and forfeited payments are the sole responsibility of the traveler.

Amy Thomasson, Amy Plans Your Magic, LLC, and Travelmation bear no responsibility or liability for consequences arising from traveler conduct.

Airline Check-In, Passenger Data & Trusted Traveler Programs You are solely responsible for completing airline check-in and for ensuring that all passenger information entered during check-in or through airline-managed systems is accurate and complete, including but not limited to passport number, expiration date, issuing country, name formatting, date of birth, gender, visa or entry documentation, and any other required travel data.

Errors or omissions made during airline check-in, including denial of boarding or loss of benefits, are not the responsibility of Amy Thomasson or Travelmation.

If you are enrolled in TSA PreCheck, Global Entry, or another trusted traveler program, you are responsible for ensuring that your Known Traveler Number (KTN) is correctly entered and matches your government-issued identification. If expedited screening does not appear on your reservation or boarding pass, resolution is between you and the airline or issuing authority, not the travel advisor.

Responsibility for Traveling Party The primary client making arrangements represents and warrants that they have authority to act on behalf of all members of the traveling party and agrees to be financially and contractually responsible for the conduct, compliance, and obligations of all travelers included in the booking.

Any losses, penalties, denied services, removals, detentions, or additional costs arising from the actions or omissions of any member of the traveling party shall be the sole responsibility of the client and travelers involved.

Hotel Loyalty Programs & Membership Benefits If you provide hotel loyalty program numbers or membership information, you are responsible for ensuring that the information is accurate and current.

Hotel loyalty benefits, points accrual, elite status recognition, upgrades, and amenities are governed solely by hotel brand policies, booking channels, availability, and system limitations. Amy Thomasson and Travelmation do not guarantee the application or honoring of loyalty benefits.

If loyalty benefits are not applied or recognized, resolution is between the traveler and the hotel directly and does not constitute an error or omission by the travel advisor.

Package Pricing - Exclusions If you have not paid for your vacation in full, you will be responsible for any increases in the price of all non-air components of the vacation package. Travelmation, Amy Thomasson, and their suppliers reserve the right to re-invoice your reservation should an error be made in computing your vacation price. You may incur additional expenses that are not included in the package price, including but not limited to (unless otherwise noted): gratuities, meals and beverages, passport/visa fees, departure taxes, environmental levies and hotel energy surcharges, resort fees, car seats, transfers, optional excursions, and items of a personal nature. Rates for packages including a rental car may not include state/local taxes, gasoline, optional insurance, Collision Damage Waiver (CDW), under-age driver charges if under the age of 25, or airport charges, which are payable directly to the rental car company. Minimum age requirements apply - contact your travel advisor or the rental car company for information. A valid driver's license and major credit card in driver's name are required.

Special Requests If you request special arrangements such as adjoining rooms/room locations, bedding requests, specific assistance, or special meals, we will pass on your request to the vendor on your behalf. However, since these requests lie outside our contracts with our suppliers, we cannot guarantee special requests unless otherwise stated.

Hazardous Materials Restrictions and Insecticide Notice Federal law forbids the carriage of hazardous materials aboard aircraft in your luggage or on your person. A violation can result in five years' imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radioactive materials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radio-pharmaceuticals. There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in your luggage and certain smoking materials carried on your person. Special restrictions and limitations for transporting Hazardous Materials and specifically Lithium Ion batteries, refer to www.faa.gov/go/packsafe for more information. In the event a carry-on bag cannot be accommodated in the passenger cabin and has to be placed below in a cargo bin for any reason, any electronic device or spare Lithium-ion or any other type of battery permitted in carry-on baggage MUST be removed from the carry-on bag and remain in the possession of the passenger in the passenger cabin. For further information, contact your airline representative. Some countries may require aircraft cabin insecticide treatment for in-bound foreign flights. A list of such countries is available at https://www.transportation.gov/airconsumer/spray.

Health & Safety Tips for Travelers Before booking travel and before your travel dates, we strongly recommend that you visit the U.S. Department of State website travel.state.gov, as well as the Centers for Disease Control and Prevention website, cdc.gov, which include important information on foreign travel such as travel advisories, warnings and restrictions issued by the U.S. government. You are responsible for complying with the health requirements of the countries you intend to visit. If you make a booking, you are confirming that you have followed our recommendations above and forever waive any argument that we should have done anything further with respect to warnings or alerts. Check with your physician regarding any immunizations that may be recommended or required. Use common sense while vacationing abroad. For example, if you choose to drink alcohol, do so in moderation. In addition, be cognizant of the effects of mixing alcohol and certain medications. Should someone in your party become ill, alert the resort front desk for immediate medical attention or call the emergency number provided by the resort. Also advise your Resort Representative as soon as possible, who may be able to provide assistance. If you have medical issues or concerns about medical services, we urge you to contact your resort with specific questions. Please be aware that medical standards and training of emergency responders and resort medical facilities vary greatly, and health care abroad may not be the same as you might expect at home. It may be standard policy for hospitals and medical providers abroad to require cash payment upfront for services. Check with your insurance provider regarding claims for reimbursement. Sports and aquatic equipment, especially scuba gear, may not meet U.S. safety standards and many resort pools and beaches may lack lifeguards. Balcony railing heights in Mexico are lower than the mandated heights in the United States, and also may be lower in other countries. Low balcony railings create a risk of falls, which may result in serious injury or death. Bottled drinking water is recommended. BY OFFERING TRAVEL PRODUCTS IN PARTICULAR DESTINATIONS AND INTERNATIONAL DESTINATIONS, WE DO NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH AREAS IS ADVISABLE OR WITHOUT RISK, AND ARE NOT LIABLE FOR DAMAGES OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS.

Client-Caused Delays, Missed Services & Itinerary Disruptions Amy Thomasson and Travelmation are not responsible for delays, missed services, forfeited components, or additional costs resulting from client actions or omissions, including late arrival, failure to follow instructions, missed transfers, deviation from the itinerary, or failure to be present at required times and locations.

By planning travel with Amy Thomasson, you acknowledge that Amy Thomasson acts simply as a booking agent for suppliers, tour operators, cruise lines, hotels, airlines, charters, bus companies, ground transportation provider, and other suppliers providing accommodations, transportation, and other services. Amy Thomasson is not a provider of travel services. Notwithstanding the foregoing, Amy Thomasson provides independent professional planning, advisory, administrative, and coordination services, which are separate from and in addition to supplier-provided travel services. Amy Thomasson accepts bookings solely as the booking agent for the suppliers listed on your itinerary. Separate supplier terms & conditions will apply to your booking. You understand that by booking travel with Amy Thomasson, you are also agreeing to the terms and conditions of each supplier listed on your itinerary and/or credit card authorization form. You agree that you will abide by the terms and conditions of purchase imposed by any supplier that you have selected as a service provider on an itinerary that you have approved. In the event of any conflict between these Terms & Conditions and those of a travel supplier, the supplier’s terms and conditions shall govern. Notwithstanding the foregoing, Amy Thomasson provides independent professional planning, advisory, administrative, and coordination services, which are separate from and in addition to supplier-provided travel services.

Supplier Terms & Conditions Responsibility You acknowledge and agree that each travel supplier (including but not limited to airlines, hotels, cruise lines, tour operators, transportation providers, and activity vendors) maintains its own Terms & Conditions, cancellation policies, fare rules, and conditions of carriage. It is your responsibility to review, understand, and accept the applicable supplier Terms & Conditions for each booking made on your behalf. Failure to review supplier Terms & Conditions does not relieve you of responsibility for compliance with those terms.

Assumption of Risk & Limitation of Liability Client understands and agrees that travel carries inherent risks, including but not limited to accidents, illness, injury, disease, pandemics, natural disasters, acts of terrorism, criminal activity, government actions, or even death. By booking travel through Amy Thomasson, the Client voluntarily assumes all such risks. Client agrees that Amy Thomasson, Travelmation, and their employees, affiliates, and agents shall not be held liable for any claims, damages, losses, or expenses arising from these risks, and that any remedy lies solely against the travel supplier(s) providing the services. The Client agrees and understands that any recovery from Amy Thomasson shall in all cases be limited to the commissions and service fees actually received by her for the booking at issue. In no event shall Amy Thomasson or Travelmation be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to lost profits, even if advised of the possibility of such damages.

Photography, Testimonials & Marketing Use Unless you notify Amy Thomasson / Amy Plans Your Magic, LLC in writing prior to travel, you grant permission for the use of photographs, video, testimonials, written feedback, and general trip descriptions voluntarily shared by you for marketing, educational, and promotional purposes. No sensitive personal information will be used without express consent. Permission may be revoked in writing for future use.

Insurance Failure to purchase travel insurance constitutes a knowing and voluntary declination of coverage, whether or not an insurance waiver form is completed. By proceeding, you acknowledge that you have been offered the option to purchase trip cancellation/interruption and medical evacuation insurance.

Amy Thomasson is not a licensed insurance agent and does not provide insurance advice or coverage, but may offer quotes for policies sold by third-party insurers; failure to purchase travel insurance does not create liability for Amy Thomasson, Amy Plans Your Magic, LLC, or Travelmation.

Amy Thomasson is not responsible for any arrangements that have not been made by her. She assumes no responsibility for costs and fees that you incur for arrangements that you made yourself. If you make your own flight arrangements, Amy Thomasson is not responsible for any loss resulting from your cancellation or changes. Amy Thomasson cannot assist you with any schedule changes or delays related to air reservations not made by her. It may not be an option to earn frequent flyer miles or other loyalty points related to your reservation. Hotel and airline rewards points cannot be redeemed by Amy Thomasson.

You are completely responsible for all charges, fees, duties, taxes, and assessments arising from your travel bookings through Amy Thomasson. By submitting this credit card authorization, you agree to allow Amy Thomasson to use your payment method on your behalf to purchase travel products from suppliers. You agree not to file any dispute with your bank or credit card company to avoid or violate any booking terms and conditions of Amy Thomasson or her suppliers, including cancellations or changes of itinerary or arrangements for reasons beyond the control of Amy Thomasson or her suppliers. If you attempt to chargeback, reverse, or recollect a previously authorized trip payment, Amy Thomasson reserves the right to collect all additional costs, fees, and expenses associated with such chargeback, reversal, or recollection including, but not limited to, attorney fees.

All payments for travel are due before departure unless otherwise stated. Suppliers may require travelers to make payment in US dollars or in foreign currency when booking through Amy Thomasson. You understand that failure to make your final payment or violating any suppliers conditions of purchase may result in cancellation of your reservations, in being denied access to your flight, tour, hotel, cruise, or other travel service. Additionally you may forfeit any monies paid for your reservation. In some cases, no refund will be given once a booking is made and a deposit is paid. All cancellations must be sent to Amy Thomasson in writing. As a result of cancellation or changes to reservations, Amy Thomasson and suppliers cancellation penalties will apply. Cancellation fees will be charged to the credit card you authorized to pay for travel services or deducted from the supplier's refund.

Should you decide to change any portion of your trip after booking is complete, Amy Thomasson will attempt to assist you. Some bookings may not be eligible for change, and you are responsible for any cost increases imposed by suppliers, as well as Amy Thomasson's and/or supplier change fees.

When you receive your travel confirmations, it is your responsibility to review and verify all information for accuracy. You will contact Amy Thomasson immediately if changes or corrections are needed. If you have not notified her within 24 hours of receiving your travel confirmation, Amy Thomasson bears no responsibility for any additional costs associated with making changes or corrections. Amy Thomasson relies on the information, selections, and approvals provided by the client when booking travel arrangements.

Your airline ticket is a contract between you and the airline, even if purchased by Amy Thomasson. You understand that Amy Thomasson acts simply as a booking agent for the air carrier and does not handle or hold client funds for airline tickets. Amy Thomasson is not a Merchant of Record as defined by the Department of Transportation. Because Amy Thomasson does not hold or handle client funds, you understand that any refund for cancelled or delayed flights, baggage fees, or seat assignments must come directly from the airline and not from Amy Thomasson.

Frequent flyer mileage accrual is at the discretion of the airline. Amy Thomasson has no liability if accruals are denied or if upgrades are not allowed. Seat assignments are not guaranteed, even after they are assigned, and Amy Thomasson has no control over seat assignments.

Amy Thomasson has solely received commission and fees for travel transactions. The client agrees and understands that any recovery from Amy Thomasson will be limited to the amount of commission and fees actually received.

You warrant that you are at least 18 years old and have the legal authority to enter into this agreement and make travel bookings with Amy Thomasson. You agree to be financially responsible for all travel bookings. You warrant that all information provided by you on your behalf for yourself, your family members, members of your household, other members of your traveling party, and others for whom you are authorized to make travel bookings is true and accurate. You agree that you will only make bona fide travel bookings with Amy Thomasson and her suppliers. You acknowledge that any false or fraudulent reservations are prohibited.

Governing Law & Venue
These Terms & Conditions shall be governed by and construed in accordance with the laws of the state in which Amy Plans Your Magic, LLC is registered and principally operates, without regard to conflict-of-law principles. Any legal action, claim, or proceeding arising out of or relating to these Terms & Conditions or services provided shall be brought exclusively in a court of competent jurisdiction located in that state, and the parties hereby consent to personal jurisdiction and venue therein.

Time Limitation on Claims Any claim, dispute, or cause of action arising out of or relating to services provided by Amy Thomasson, Amy Plans Your Magic, LLC, or Travelmation must be commenced within twelve (12) months after the date the cause of action first arose. Any claim not brought within this time period is permanently barred.

Class Action Waiver You agree that any claim or dispute against Amy Thomasson, Amy Plans Your Magic, LLC, or Travelmation shall be brought solely in your individual capacity and not as a plaintiff or class member in any purported class, collective, representative, or consolidated action. You expressly waive any right to participate in or bring such actions.

Electronic Delivery of Services & Documentation All services, recommendations, itineraries, quotes, confirmations, documents, and communications may be delivered electronically, including but not limited to email, secure portals, digital itinerary platforms, or supplier systems. The Client acknowledges and agrees that electronic delivery constitutes valid, complete, and sufficient delivery of services. Planning, advisory, and professional services are deemed rendered and complete upon electronic delivery of planning materials, recommendations, or quote options, regardless of whether the Client opens, reviews, downloads, prints, or responds to such materials. Failure to review electronically delivered materials does not negate delivery, completion of services, or fees earned.

Use of Third-Party Platforms & Technology Amy Thomasson may utilize third-party platforms, software, booking tools, itinerary systems, communication services, or supplier portals in the course of providing planning, advisory, and booking services. These may include, but are not limited to, itinerary management tools, scheduling systems, supplier booking platforms, and document delivery services. Amy Thomasson is not responsible for outages, access issues, technical failures, data delays, errors, or limitations arising from third-party platforms or supplier systems beyond her reasonable control. The Client acknowledges that such tools are provided by independent third parties and agrees that use of these platforms does not alter the nature of services provided, the completion of services rendered, or the non-refundable status of professional service fees once earned.

These terms and conditions and any other terms and conditions referenced above constitute the entire agreement between the client and Amy Thomasson with respect to travel bookings made with Amy Thomasson by any means and supersede all prior or contemporaneous communications and proposals whether electronic, oral, or written between the client and Amy Thomasson. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. By providing my electronic signature or otherwise proceeding with booking, I affirm that I have read, understood, and agree to these Terms and Conditions and acknowledge that my acceptance carries the same legal force and effect as a handwritten signature.
